These Terms of Service (“Terms”) govern your access to and use of Bamerix.com (the “Site”) and your purchase of products through the Site.

By accessing the Site or placing an order, you agree to these Terms.

Bamerix currently sells and ships products within the United States only.

1. About Bamerix

Bamerix is an online lifestyle retail brand serving customers in the United States, offering graphic apparel, footwear, accessories, home and living products, personalized gifts, pet accessories, sports and games, and other selected merchandise.

Our catalog may include T-shirts, hoodies, sweatshirts, dresses, skirts, leggings, sneakers, hats and caps, bags, phone cases, jewelry, car accessories, mugs, drinkware, blankets, home decor, personalized signs and plaques, puzzles, playing cards, pickleball products, and pet accessories.

Selected products may offer personalization options, including names, initials, photographs, messages, or other customer-provided details.

Products may be manufactured, printed, assembled, personalized, packaged, and fulfilled by specialized production and fulfillment partners.

Product availability, production methods, and fulfillment locations may vary depending on the product and order.

2. Eligibility

By using the Site or placing an order, you represent that you are legally capable of entering into a binding agreement under applicable law.

If you are under the age of majority in your state of residence, you may use the Site only with the involvement and permission of a parent or legal guardian.

You may not use our Site, products, or services for any unlawful or unauthorized purpose.

3. Product Information

We make reasonable efforts to display product descriptions, specifications, dimensions, materials, colors, personalization options, photographs, and other product information accurately.

Product images are provided for illustrative purposes. Appearance may vary depending on screen settings, materials, production processes, and other factors.

Because some products are individually printed or manufactured, minor variations in print placement, color, texture, dimensions within normal manufacturing tolerances, or appearance may occur and do not necessarily constitute a defect.

Customers should review all product information, dimensions, size guides, personalization instructions, and available options before placing an order.

4. Personalized & Custom Products

Many Bamerix products may be created specifically according to information provided by the customer.

Depending on the product, personalization may include names, initials, dates, numbers, messages, photographs, images, artwork, or other customer-selected elements.

Customers are responsible for carefully reviewing all personalization information before submitting an order.

We generally reproduce personalization according to the information submitted with the order.

Errors contained in customer-submitted personalization information are generally not considered production defects.

5. Customer-Submitted Content

If you provide photographs, artwork, logos, text, graphics, or other materials for use on a personalized product (“Customer Content”), you represent that you have the rights, permissions, licenses, or authorizations necessary for that content to be used to fulfill your order.

You may not submit content that:

Infringes copyrights, trademarks, privacy rights, publicity rights, or other third-party rights
Is unlawful
Is fraudulent or misleading
Contains malicious software or code
Otherwise violates applicable law

You grant Bamerix and its service providers a limited right to use, reproduce, process, transmit, and technically modify Customer Content only as reasonably necessary to produce, fulfill, support, and deliver your order and provide the related services.

We may reject or cancel an order involving Customer Content that we reasonably believe violates these Terms or applicable law.

6. Orders

When you place an order, you agree that the information you provide is complete and accurate.

After submitting an order, you may receive an order confirmation by email.

We may refuse, cancel, or limit an order when reasonably necessary, including because of product unavailability, pricing or listing errors, payment problems, suspected fraud, invalid shipping information, prohibited Customer Content, production limitations, or violations of these Terms.

If Bamerix cancels an order after payment has been successfully collected, the applicable refund will be issued.

7. Changes & Cancellations

Many Bamerix products enter production shortly after an order is placed.

If you need to change or cancel an order, contact us through our Contact Us page as soon as possible.

We will attempt to accommodate the request when possible, but we cannot guarantee that an order can be changed or canceled after production or fulfillment has begun.

8. Prices, Currency & Taxes

All prices displayed on Bamerix.com are stated in U.S. dollars (USD) unless otherwise indicated.

Prices may change for future purchases without prior notice.

Applicable shipping charges, taxes, and other charges, if any, will be displayed during checkout as appropriate.

Applicable sales tax may be calculated based on the shipping destination, products purchased, and applicable state or local requirements.

Promotional offers and discount codes may be subject to additional conditions.

9. Payments

Payments are processed through secure third-party payment service providers available through our ecommerce checkout.

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charges associated with your order.

Payment providers may process payment information according to their own terms and privacy policies.

Bamerix does not necessarily receive or store complete payment card information.

10. Production & Fulfillment

Many Bamerix products are produced, printed, assembled, or otherwise prepared on demand after an order is placed.

Production time is separate from shipping time.

Products may be produced and fulfilled by different specialized production facilities depending on the product, availability, destination, and other fulfillment requirements.

If an order contains multiple products, those products may be produced at different facilities and may arrive in separate packages or on different dates.

11. Shipping & Delivery

Bamerix currently ships to eligible addresses within the United States only.

Shipping and delivery estimates are estimates and are not guaranteed unless expressly stated otherwise.

Delivery may be affected by circumstances outside our reasonable control, including carrier delays, severe weather, holidays, seasonal demand, transportation disruptions, and other exceptional circumstances.

12. Shipping Addresses

Customers are responsible for providing complete and accurate shipping information.

Please carefully review your recipient name, street address, apartment or unit number, city, state, ZIP code, and other required delivery information before completing your purchase.

If you discover an address error after placing an order, contact us as soon as possible.

We cannot guarantee that shipping information can be changed after an order has entered production or fulfillment.

13. Returns & Refunds

Returns, replacements, and refunds are governed by our Return & Refund Policy.

Eligible non-personalized products may be returned according to our applicable 30-day return policy.

Personalized and custom products are generally not eligible for return or refund solely because of a change of mind, personal preference, or customer personalization error, except where otherwise required by applicable law.

This does not affect your rights if a product arrives damaged, defective, incorrect, or with a production error attributable to Bamerix or our fulfillment partner.

14. Damaged, Defective or Incorrect Products

If you receive a product that is damaged, defective, materially different from what you ordered, or contains a production or personalization error attributable to Bamerix or our fulfillment partner, please contact us.

We may request:

Your order number
A description of the problem
Photographs of the product
Photographs of the packaging where relevant
Other information reasonably necessary to review the claim

Depending on the circumstances, an appropriate remedy may include a replacement or refund.

15. Intellectual Property

Unless otherwise stated, Bamerix.com and its original content, including the Bamerix name and branding, logos, graphics, illustrations, designs, photographs, text, and other materials, are owned by or licensed to Amerix United LLC and may be protected by applicable intellectual property laws.

Purchasing a product does not transfer ownership of intellectual property associated with Bamerix branding, designs, artwork, or Site content.

Third-party names, trademarks, designs, and other intellectual property remain the property of their respective owners.

16. Reviews & User Content

If Bamerix allows customers to submit reviews, photographs, comments, or other public content, you represent that you have the right to submit that content.

You may not submit content that is unlawful, fraudulent, defamatory, threatening, infringing, malicious, or otherwise violates applicable law or the rights of another person.

Content intended for public display may be used and displayed by Bamerix in connection with the Site and promotion of Bamerix, subject to applicable law and our Privacy Policy.

17. Third-Party Services

Bamerix uses third-party service providers to support portions of our operations, which may include ecommerce infrastructure, payment processing, production, fulfillment, shipping, tracking, analytics, communications, marketing, fraud prevention, hosting, security, and customer support.

Use of certain third-party features may also be subject to the applicable provider's terms and privacy practices.

18. Website Availability

We make reasonable efforts to keep Bamerix.com available and functioning properly but cannot guarantee uninterrupted or error-free access.

We may update, modify, suspend, or discontinue portions of the Site or particular products when reasonably necessary.

19. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

WE DO NOT DISCLAIM OR LIMIT ANY WARRANTY OR CONSUMER RIGHT THAT CANNOT LAWFULLY BE DISCLAIMED OR LIMITED.

20. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AMERIX UNITED LLC AND BAMERIX WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OF THE SITE OR PRODUCTS, EXCEPT WHERE SUCH LIABILITY CANNOT LAWFULLY BE LIMITED OR EXCLUDED.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

21. Fraud & Misuse

We may investigate, refuse, or cancel transactions that we reasonably believe involve fraud, unauthorized payment activity, abuse of promotions, misuse of the Site, or unlawful activity.

We may cooperate with payment providers, financial institutions, carriers, ecommerce platforms, and lawful authorities where reasonably necessary and permitted by law.

Transactional communications are separate from optional marketing communications.

Nothing in this section prevents either party from exercising rights or remedies available under applicable law.
